Off-plan in Spain 2026: The Law That Protects Your Deposit

Every off-plan Spanish property purchase involves paying money to a developer months or years before the property physically exists. Spanish law protects that money if the developer collapses, refuses to deliver or delays past contract terms. The protection is not automatic – it depends on the developer meeting specific documentation obligations. This article walks through what Law 20/2015 requires, what the buyer's checklist looks like, and where developer practice varies from the letter of the law.

What Law 20/2015 requires
Since 1 January 2016, every Spanish developer taking staged payments from a buyer before physical delivery must:
- Hold the staged-payment funds in a separate escrow bank account (cuenta especial), never in the developer's operating account.
- Contract an aval bancario (bank guarantee) or an insurance policy from a licensed insurance company that covers 100% of the staged payments plus statutory interest.
- Deliver the guarantee documentation to the buyer at contract signing, not later than the first staged payment.
- Maintain the guarantee validity until the property is delivered with the first-occupation licence (LPO or licencia de primera ocupación).
What the buyer verifies before signing
The buyer's due-diligence checklist at reservation and contract-signing stage:

Without a valid aval or insurance policy that meets all six checkpoints, refuse to make staged payments beyond the reservation deposit.
What happens if the developer collapses
Best case: developer misses a milestone (foundation, structure, roof) by more than 60 days without valid cause. Buyer or their lawyer notifies the developer in writing (burofax), giving 30-day cure notice. If no cure, the buyer terminates the contract citing Law 20/2015 and demands full deposit refund from the guarantor.
Worst case: developer files for insolvency (concurso de acreedores). The insolvency administrator inherits the developer's obligations. The aval bancario or insurance policy operates independently of the insolvency: the guarantor pays the buyer directly, subject to the policy terms. Refund timeline typically 30-90 days from the formal demand.
Fraud case: rare but has happened. Developer never posts a valid aval, buyer pays staged payments anyway, developer disappears. Recovery through Spanish courts possible but slow (12-36 months) and success depends on tracing assets. Prevention: verify the aval at signing.
Timeline of a typical off-plan purchase
- Month 0: Sign reservation contract (€3,000-€6,000 non-refundable deposit against developer, refundable if due diligence fails).
- Month 1: Sign purchase contract with the developer + verify aval bancario delivered. Pay first staged payment (typically 10% of purchase price).
- Month 3-5: Foundation phase complete, pay second staged payment (10%).
- Month 8-12: Structure and roof phase, pay further tranches (10-15% each).
- Month 12-20: Interior finish, final tranches.
- Month 18-24: First-occupation licence (LPO) issued by the town hall, developer notifies buyer of ready-to-deed.
- Month 18-26: Notary appointment; balance paid; keys delivered.
Standard developer red flags
Aval delivered "in the next 30 days" instead of at contract signing. Refuse. The law requires it at first payment.
Staged payments to the developer's own operating account rather than a separate cuenta especial. Refuse. The law requires separation.
Aval issued by an unknown small bank. Verify the bank appears on the Bank of Spain's registered institution list. Avoid off-the-radar guarantors.
Aval expiry date matches the promised handover date exactly. Insist on a 3-month buffer past handover so any delivery slip does not leave you uncovered.
Developer offers a "personal guarantee" from a company director instead of an aval bancario. Not law-compliant. Refuse.
Developer offers a mortgage-holdback in lieu of the aval. Not law-compliant for staged payments before mortgage draw-down. Refuse for pre-mortgage payments.

FAQ
Does the aval apply to my reservation deposit or only later staged payments? Only to staged payments after the purchase contract. Reservation deposits are typically not covered by Law 20/2015 protection. That is why reservation deposits are small (€3,000-€6,000) relative to staged payments.
What if I pay in a foreign currency? Convert to EUR at the exchange rate on the payment date. The aval covers the EUR amount received by the developer, not the source-currency amount you paid.
Can I claim interest on delayed refunds? Yes. Law 20/2015 mandates 6% statutory interest on refunded deposits, calculated from the date the buyer formally demanded refund to the date the guarantor pays.
What is the difference between an aval bancario and a caución póliza? Both are law-compliant guarantees. Aval bancario is issued by a bank; caución póliza is issued by a licensed insurance company. Aval bancarios are the more common form in the Costa Blanca off-plan market in 2026.
Should I hire a lawyer for off-plan due diligence? Yes. Off-plan carries more contract clauses and more paperwork risk than resale. Budget €1,800-€2,800 for a lawyer to review the developer contract, verify the aval and coordinate the notary handover.
