Spain's Land Registry Went Digital: What Changed and What Didn'tWesna Group

Ley 11/2023 put the property registry on an electronic folio from May 2024 and gave notaries a stamped electronic deed from April 2025. It did not make a Spanish house purchase something you can sign by video call.

Ley 11/2023 moved the Spanish property registry onto an electronic folio from 9 May 2024, and from 1 April 2025 it gave notaries a stamped electronic deed carrying the same force as paper. Both are real changes. Neither lets you buy a Spanish house by video call, and that is where buyers keep being misled.

What actually changed, and when

Ley 11/2023 transposed an EU digitalisation directive and, on the way through, rewrote large parts of the Ley del Notariado and the Ley Hipotecaria. It arrived in stages rather than on one day, which is why buyers hear contradictory things from different lawyers. The consolidated text sits on the BOE.

The escritura travelling to the registry electronically is not new and did not arrive with this law. Article 112 of Ley 24/2001 and article 249 of the Reglamento Notarial have obliged the notary to send an authorised electronic copy to the registry on the day of signing, or the next working day, unless the parties object. That has been routine on the Costa Blanca for close to two decades. What changed is that the record at both ends is now natively electronic rather than a scan of a paper original.

The video-conference deed will not sign your purchase

Article 17 ter of the Ley del Notariado carries a closed list of acts a notary may authorise by video-conference: company incorporation and corporate resolutions, commercial policies, powers for court proceedings and for dealings with public administrations, revocation of those powers, payment letters and guarantee cancellations, signature legitimations, and new-build declarations that do not adjudicate property. Property sales are not on the list. Neither are mortgage loans, donations or deeds of inheritance.

Ratifying a compraventa by video-conference is out as well. The article mentions powers granted for specific acts, and it is tempting to read a power to buy one named apartment into that phrase. Notaries have not, so do not plan a purchase around it. The remote route is what it always was: a notarial power of attorney signed in person, in Spain or before a notary at home with an apostille.

The notarial portal still helps. You verify your identity once, book a slot with the notary you choose, exchange documents securely beforehand, and receive electronic copies of the signed deed instead of collecting paper in Spain. A six-week wait for an appointment is a staffing problem, not a technology one, and we cover that in notary appointment waits. None of it alters what the notary is there to do.

What has not changed

Inscription is still voluntary. Ownership passes at the notary, and registering the deed protects you against third parties rather than creating your title. Skipping it is legal and reckless. The one exception is a mortgage, which does not exist until it is inscribed.

The registry also stays shut until the tax is settled. Article 254 of the Ley Hipotecaria blocks inscription until ITP or AJD has been filed and paid, and that step is the genuine bottleneck. The registrar has 15 days from the presentation entry to qualify and inscribe, but the clock does not start until the tax receipt is in the file. Four to eight weeks from signing to inscription remains normal.

The Catastro is still a separate system, run by a separate ministry for a different purpose. The cadastral reference and the registry description disagree on a great many properties, and Ley 11/2023 did nothing to reconcile them.

The electronic folio is also being built as it goes. The law provides for progressive implementation, so a finca whose last registry operation was in the 1990s sits in a paper book until something happens to it, and old charges are read from the historic entries. Registries in Alicante, Murcia and Almería answer at different speeds.

What a buyer should do differently now

Order your own nota simple rather than trusting the copy the seller hands you. Through the Registradores electronic office it costs EUR 9.02 plus IVA and arrives sealed with a verification code. Use the información continuada for the gap between arras and completion. At EUR 12.03 plus IVA it keeps the property under continuous watch, so aim that window at the days either side of your escritura. A charge registered in that gap is exactly the risk a single snapshot cannot catch.

Once you are the inscribed owner, file an electronic address with the registry and switch on owner alerts. You get an email whenever anything is presented against your finca. For a non-resident whose apartment sits empty nine months a year, that is cheap insurance.

At the notary, ask for the copia autorizada electrónica alongside the paper copy. It is the version you can forward to a bank or a lawyer without couriering anything. And never agree to skip telematic presentation, which puts your deed behind anything filed in the meantime.

Two questions buyers ask

Can I buy a Spanish property entirely by video call in 2026?

No. Article 17 ter of the Ley del Notariado leaves property sales, mortgage loans, donations and inheritance deeds off the video-conference list. You attend in person, or you send a representative holding a notarial power of attorney. Everything around the signing has moved online. The signing itself has not.

Is the inscribed deed delivered electronically now?

Yes. Since May 2024 the registry issues formal publicity in electronic form, signed or sealed by the registrar and carrying a verification code anyone can check. Ask your lawyer to forward the file rather than waiting to collect paper from a counter in Spain.
