Rental Price Ceilings Spain 2026: Regions Affected

Spain's rental-price-ceiling regime under the Housing Act (Ley 12/2023) is in effect in 2026 but applies unevenly. Cataluña has the fullest implementation. Comunidad Valenciana partially adopted. Madrid, Andalucía and the Balearic Islands explicitly opted out. This article summarises which regions actually cap rental prices in 2026, who is affected, and what it means for buy-to-let investors on the Costa Blanca.

The national framework
Ley 12/2023 gave autonomous communities the option to designate "zonas tensionadas" (stressed rental markets) where new-tenancy rental price ceilings would apply. In designated zones:
- Small landlord (fewer than 10 properties): new tenancies must offer the previous tenant's rent or a limited adjustment.
- Large landlord (10+ properties, i.e. institutional): new tenancies capped at the reference rent index (IPRIC) published by the Ministry of Housing per municipal zone.
- Existing tenants: rent adjustments limited to the IPRIC index annually, replacing the old IPC-only formula.
Each autonomous community decides whether to designate zones. Where no designation, the pre-2023 tenancy law applies (LAU 1994) with standard 3-5 year contracts and IPC-based annual increases.
Regional implementation 2026
Cataluña. Fullest implementation. 271 zones designated including central Barcelona, Girona metropolitan area and coastal Girona province. New tenancies capped at IPRIC index. Enforcement active since Q4 2024.
País Vasco. 5 zones designated (Bilbao centre, Donostia centre). Enforcement active.
Comunidad Valenciana. Partial adoption. Valencia city zones designated in Q2 2026. Municipalities including Alicante and Elche in review. Costa Blanca coastal municipalities (Torrevieja, Orihuela Costa, Denia, Calpe, Villajoyosa) have NOT designated zones as of July 2026.
Baleares. Rejected the framework at regional level. Rental prices unregulated (subject to standard LAU).
Andalucía, Madrid, Galicia, Castilla-La Mancha, Región de Murcia. All explicitly opted out. No rental-price ceilings in effect.
Aragón, Navarra, Cantabria, Extremadura, Asturias, Canarias, La Rioja, Ceuta, Melilla. No zones designated as of July 2026.
What this means for Costa Blanca buy-to-let
Costa Blanca coastal towns (Torrevieja, Orihuela Costa, Los Alcázares, Pilar de la Horadada, Denia, Calpe, Villajoyosa, Alicante) do NOT have rental-price ceilings in 2026. Landlords set new-tenancy rents at market. Existing tenants receive annual increases per LAU 1994 default (IPC-linked, capped at 2% for 2026 per the transitional Ley 12/2023 provision).
Watch item: Valencia city zone designations in Q2 2026. If Alicante or other Costa Blanca municipalities designate zones in H2 2026 or 2027, Costa Blanca landlord rental economics change.
For now: buy-to-let yields on the Costa Blanca (5.2-6.6% gross depending on town per our long-term yields article) remain unaffected by the regime.
Practical checklist for existing landlords
- Verify your municipality's zone designation status via the Boletín Oficial de la Comunidad for the Comunidad Valenciana.
- Confirm your rental contract references the correct annual-increase formula (IPRIC in designated zones, IPC-capped-at-2% elsewhere for 2026).
- Non-resident landlord: your gestor updates Modelo 210 IRNR filings against the correct rental income figures.
For buyers evaluating rental strategy
The Cataluña experience since Q4 2024 shows:
- New-tenancy rents landed 8-14% below what unregulated pricing would have delivered.
- Vacancy periods extended by 3-5 weeks average as landlords held out for higher offers.
- Small-landlord segment shifted 6-8% of stock from long-term to seasonal / mid-term rentals to avoid the cap.
If similar zone designations reach Costa Blanca coastal towns in 2027, expect similar patterns.
