# VPO Spain 2026: Price Caps, Rules and Who Can Buy

> Protection on new VPO built on reserved land never expires, and a 30-year floor applies everywhere else. Income caps sit near 4.5 times IPREM, roughly EUR 37,800 a year, and the residence test rules out non-resident buyers. Check the nota simple before you sign.

Since Ley 12/2023 came into force, protection on new VPO built on land reserved for it never expires, and everywhere else the qualification period lasts a minimum of thirty years. That matters to foreign buyers for one blunt reason: you almost certainly cannot buy one. VPO is price-capped housing for residents on limited incomes, and the regional authority checks eligibility before any sale completes.

## What a protected home actually is

Vivienda de Protección Oficial is housing built or sold under a public protection regime. The developer accepts a capped sale price and takes something back for it: cheaper land, subsidised finance, favourable tax treatment. In the Comunitat Valenciana the current stock goes by vivienda de protección pública, or VPP, while flats qualified under the state regimes of the 1970s and 1980s still carry the older VPO tag. The governing statute is [Ley 12/2023, de 24 de mayo, por el derecho a la vivienda](https://www.boe.es/buscar/act.php?id=BOE-A-2023-12203), published in the BOE and layered over regional rules. In Valencian territory that means Ley 8/2004 and the Reglamento de Protección Pública a la Vivienda, approved by Decreto 75/2007.

The cap itself is a módulo: a maximum euro figure per square metre of superficie útil, multiplied by a coefficient for the municipality's zone. Coastal towns sit in the higher bands, and the capped price still lands well below what the same building would fetch on the open market. Two details catch buyers out. The módulo applies to m2 útil while portals quote m2 construido, so the real gap is wider than a straight comparison suggests. Garage spaces and storerooms carry their own lower caps, which stops a developer putting the missing money back on the annexes.

Low price alone proves nothing. Plenty of unprotected stock is simply cheap: [WG-13, a 76 m2 apartment in Alfaz del Pi at EUR 149,000](/property/wg-13), works out near EUR 1,960 per m2, less than half our catalogue median of EUR 319,900 for an apartment, and nothing on its title restricts the resale. ## Who qualifies, and where a foreign buyer fails

Those tests also collide with the residency routes most of our clients take. A Non-Lucrative Visa applicant has to show passive income above roughly EUR 28,800 a year, while a VPO applicant has to show household income below a ceiling near EUR 37,800 and no other property anywhere. The two windows barely overlap, and the ownership test closes the matter for anyone buying a second home. ## The resale trap: cheap for the area, still protected

Nobody sells you a VPO by mistake. The risk is that a listing looks like a bargain for the street, you put down an arras deposit, and the title check three weeks later turns up a qualification with eighteen years left to run.

Three restrictions govern any transfer while the qualification stands. The seller has to notify the housing administration, which holds a right of first refusal, tanteo, and can step into a sale nobody told it about through retracto. The contract then needs an administrative visado before the notary can complete it. And the price cannot exceed the módulo, with Spanish courts treating any sobreprecio as money the buyer can claim back. Letting carries its own control: the owner needs authorisation, which keeps protected flats out of the ordinary rental market and away from the [regional rent ceilings](/blog/spain-rental-price-ceilings-2026-regions-affected) that the same law introduced.

Regional law sets the penalties. Valencian housing legislation treats an unauthorised transfer or letting as a serious or very serious infringement, with fines running from the low thousands into the tens of thousands, and the administration can move to unwind the transaction on top.

Checking takes ten minutes. Ask for the nota simple from the Registro de la Propiedad and read the marginal notes, where the calificación definitiva appears with its date and its price and use limitations. ### Can I buy a VPO if I have an NIE but live abroad?

No. An NIE is a tax identification number, not proof of residence. Protected housing requires empadronamiento in the autonomous community, entry on its housing demand register, household income under the IPREM ceiling, no other dwelling anywhere, and occupation as your permanent home. A buyer living abroad fails on residence and on use before income comes into it.

### What if the protection period has already expired?

Then it is an ordinary home and you can buy it like any other. Confirm the expiry date on the registry entry rather than taking the seller's word, and check whether the file needed a formal descalificación and actually got one.
