# Spain Property Inheritance Planning: What Heirs Actually Pay in 2026

A spouse or child inheriting a EUR 400,000 apartment in the Comunidad Valenciana or Región de Murcia pays roughly EUR 1,500 in Spanish inheritance tax in 2026, once the 99% regional bonification applies. The same inheritance in Asturias or parts of Catalonia can cost over EUR 25,000. Spanish property remains a tax-efficient estate asset, but only in the regions where our clients actually buy.

Spain's Impuesto sobre Sucesiones y Donaciones (ISD) is a state tax with regional execution. The scale and the group multipliers come from Madrid; the reductions and bonifications come from each Comunidad Autónoma. The Costa Blanca, the Costa Cálida and the Costa Almería all sit in regions that have, by 2026, erased most of the bill for direct-line family. That is the policy those regions chose, and it is why property on these coasts works as an inheritance vehicle in a way that financial assets held in a UK or Dutch brokerage account do not.

## How much Spanish inheritance tax does a family actually pay on a EUR 400,000 property in 2026?

Start with the state scale, which still frames every regional calculation. The 2026 brackets run from 7.65% on the first EUR 7,993 up to 34% above EUR 797,555, with a sliding scale in between. On a EUR 400,000 net base, the raw quota before any reductions sits near EUR 80,655. The multiplier for Group I (descendants under 21) and Group II (descendants over 21, spouse, parents) with ordinary pre-existing wealth is 1.0, so that quota is also the gross tax.

From there the region takes over. Three of the regions where Wesna operates (Valencia, Murcia and Andalucía) apply bonifications of 99% for Group I and II, or an outright exemption up to EUR 1,000,000 per heir in the Andalusian case. The resulting bill on EUR 400,000 lands in the four-figure range, often lower once the EUR 100,000 per-heir reduction for descendants and spouses is applied before the scale.

A worked comparison, same property, same family, different autonomous community:

<table>
  <thead>
    <tr><th>Region (asset location)</th><th>Group II heir, EUR 400,000 net</th><th>Approx. tax 2026</th><th>Effective rate</th></tr>
  </thead>
  <tbody>
    <tr><td>Comunidad Valenciana (Costa Blanca)</td><td>EUR 100,000 reduction + 99% bonification</td><td>EUR 500 to 1,500</td><td>0.1 to 0.4%</td></tr>
    <tr><td>Región de Murcia (Costa Cálida)</td><td>EUR 100,000 reduction + 99% bonification</td><td>EUR 500 to 1,500</td><td>0.1 to 0.4%</td></tr>
    <tr><td>Andalucía (Costa Almería)</td><td>EUR 1,000,000 reduction for Group I/II</td><td>EUR 0</td><td>0%</td></tr>
    <tr><td>Comunidad de Madrid</td><td>99% bonification</td><td>EUR 800 to 1,500</td><td>0.2 to 0.4%</td></tr>
    <tr><td>Cataluña</td><td>Scaled bonification (reduces with base)</td><td>EUR 10,000 to 18,000</td><td>2.5 to 4.5%</td></tr>
    <tr><td>Asturias</td><td>Modest reductions, state scale largely applies</td><td>EUR 22,000 to 28,000</td><td>5.5 to 7.0%</td></tr>
  </tbody>
</table>

Figures are indicative, before plusvalía municipal and before any pre-existing wealth multiplier adjustment. For a region-by-region breakdown with the exact reductions, see our [regional inheritance tax guide](/blog/spain-inheritance-tax-property-2026-regional-guide).

Two footnotes buyers underweight. First, non-residents from the EEA, and since the 2018 Supreme Court ruling non-residents from third countries including the UK, can apply the regional rules of the autonomous community where the Spanish property sits. A British child inheriting a Calpe apartment does not fall back to the harsher state scale. Second, the taxable base is set by reference to the Catastro's valor de referencia, not what you paid and not what the market says today. On that mechanic, read [the cadastral reference value explainer](/blog/cadastral-reference-spain-catastro-2026).

### Which regions treat inheritance of Spanish property most generously?

The Comunidad Valenciana raised its Group I and II bonification to 99% in May 2023 and extended the same treatment to lifetime donations formalised before a notary. Murcia has held a 99% bonification for direct-line family for several years. Andalucía reformed in 2021 and now exempts Group I and II inheritances up to EUR 1,000,000 per heir, which covers almost every residential transfer we see on the Costa Almería. Madrid runs at 99%. Castilla y León, Galicia and Cantabria have moved in the same direction.

The laggards sit in the north and northeast. Catalonia, Asturias and parts of Aragón still extract a real tax on larger estates. That matters less for a Costa Blanca portfolio than it sounds, because the asset's location, not the heir's residence, picks the regional rules. A Barcelona resident inheriting an apartment in Torrevieja is taxed under Valencian rules on that specific asset.

Group III (siblings, nephews, in-laws) and Group IV (unrelated) are a different world. The multipliers climb to 1.5882 and 2.0 respectively, and most regional bonifications shrink or disappear. If your estate plan routes a Spanish villa to a sibling or a close friend rather than a child or spouse, the effective tax rate can land between 25% and 40%. That is often the point at which structured planning, lifetime gifting or life insurance to cover the tax starts to earn its fee.

## What does Spanish inheritance planning look like at each budget tier?

The strategy flexes with estate size. Three real tiers:

**Up to EUR 300,000, single property, direct-line heirs.** No structure needed. Buy clean, in one or both spouses' names depending on the home-country regime, write a Spanish will through a local notary covering only the Spanish assets, and let the regional bonification do the work. For a two-bedroom apartment in Torrevieja around EUR 250,000, children will inherit for a few hundred euros of tax plus plusvalía municipal. Planning fees should be modest.

**EUR 300,000 to EUR 1,500,000, a primary coastal home plus perhaps a buy-to-let.** Here the choice between inheritance and lifetime donation starts to matter. In Valencia and Murcia the 99% bonification applies to donations too, provided they are notarised, so parents who want to see children settled can gift during life without punitive tax. The plusvalía municipal still falls due and the donor realises capital gains at Spanish income tax rates. For heirs over 21 the inheritance route is usually cheaper because no CGT arises on the parent's death: the step-up in base runs to the valor de referencia at the date of death. This tier benefits from a joined-up read with [capital gains tax on sale](/blog/capital-gains-tax-spain-property-sale-2026).

**EUR 1,500,000 and above, multiple properties, mixed heirs.** Estate structuring starts to earn real money here. Options include splitting ownership between spouses at purchase to use two per-heir reductions, holding through a Spanish SL (patrimonial company) when commercial activity justifies it, or using life insurance held outside Spain to fund the tax at death. For Group III and IV heirs the bill is real and should be modelled before purchase, not after. Debt secured on the Spanish property also reduces the inheritance base, which pulls non-resident mortgage structuring into the picture.

## Where does the opportunity sit now on the Costa Blanca and Costa Cálida?

Spanish house prices rose roughly 7% year-on-year in Q1 2026 at national level, with the Comunidad Valenciana and Región de Murcia running above the mean. [INE's housing price index](https://www.ine.es/dyngs/INEbase/en/operacion.htm?c=Estadistica_C&cid=1254736152838) is the primary source; our read on the same series sits in the [Q1 2026 house price note](/blog/ine-house-prices-q1-2026-spain-13-percent-yoy-2026-06-22). For an inheritance vehicle, the attractive combination is a region that both appreciates and taxes transfers lightly. The Valencian coast delivers both. The Murcian coast delivers the second half with gentler appreciation and more entry-level stock.

Concrete price points as of October 2026 across the regions that matter:

<table>
  <thead>
    <tr><th>Town</th><th>Typical family stock</th><th>Entry price</th><th>Reason it works as inheritance asset</th></tr>
  </thead>
  <tbody>
    <tr><td>Torrevieja (Costa Blanca South)</td><td>2-bed apartments, 70 to 90 m2</td><td>EUR 160,000 to 290,000</td><td>Liquid resale, 99% Valencia bonification</td></tr>
    <tr><td>Orihuela Costa</td><td>3-bed townhouses near golf</td><td>EUR 300,000 to 500,000</td><td>Rental income during holding, easy to transfer</td></tr>
    <tr><td>Calpe (Costa Blanca North)</td><td>Sea-view apartments and villas</td><td>EUR 250,000 to 800,000</td><td>Capital appreciation, strong second-hand demand</td></tr>
    <tr><td>Los Alcázares (Costa Cálida)</td><td>Golf apartments and semis</td><td>EUR 220,000 to 400,000</td><td>99% Murcia bonification, lower entry</td></tr>
    <tr><td>Vera, San Juan de los Terreros (Costa Almería)</td><td>Beachfront 2 and 3-bed apartments</td><td>EUR 180,000 to 350,000</td><td>Andalucía EUR 1M per-heir reduction</td></tr>
  </tbody>
</table>

The stock that transfers most cleanly between generations is boring: a 70 to 110 m2 apartment or townhouse in a well-run urbanisation, with a working community of owners, a transparent IBI history and a current nota simple. Prestige villas in Moraira or Altea Hills work too, though illiquidity at the top end can force heirs into a slow sale when more than one heir is involved.

## Which risks could break the inheritance planning thesis?

Three real downsides to name.

**Regional policy can reverse.** The 99% bonifications in Valencia, Murcia and Andalucía exist by regional law and can be modified by any incoming government. Catalonia tightened its regime in 2020. A policy swing in Valencia between now and the inheritance date would not retroactively tax the asset, but it would reset the arithmetic for your heirs. The planning answer is lifetime gifting or dual ownership at purchase, not hope.

**Non-resident heirs face a separate IRNR bill while they own the property.** Even with a near-zero inheritance tax, the heirs step into the shoes of the deceased for Modelo 210 purposes. If the property is empty, a notional rental income is imputed and taxed annually. If it is rented out, the net rental income is taxed at 19% for EEA residents and 24% for others. See the [Modelo 210 guide](/blog/modelo-210-non-resident-tax-spanish-property-2026). The property is cheap to inherit and not free to hold.

**Plusvalía municipal and the valor de referencia both bite at transfer.** Plusvalía is a municipal tax on the increase in cadastral land value and falls due within six months of death. The valor de referencia is set by the Catastro and is usually below market but not always, which can inflate the inheritance base in soft submarkets. Both are manageable with a competent lawyer and neither usually derails a transfer, but both are missed by heirs who assume "99% bonification" means "no bill".

## Frequently asked questions

**Does the UK inheritance tax apply as well?**
For a UK-domiciled individual, HMRC taxes worldwide assets including Spanish property. The UK-Spain double tax treaty does not cover inheritance tax directly, but unilateral credit relief in the UK allows Spanish ISD paid to be credited against UK IHT on the same asset. In practice, because Spanish ISD on direct-line heirs in Valencia or Murcia is near zero, UK IHT is the binding tax for UK-domiciled estates. Domicile planning sits outside Spanish advice.

**Can I avoid Spanish inheritance tax by holding through a company?**
Usually no, and often worse. Shares in a Spanish SL that holds residential property are themselves subject to ISD when transferred to heirs, and the regional bonifications may apply differently to shares than to direct property. For pure family succession of a holiday home, direct ownership plus a Spanish will is almost always cleaner and cheaper. Company structures earn their keep for genuine commercial letting activity or for estates holding multiple assets.

**Should parents gift the property during life instead?**
In Valencia and Murcia the 99% bonification extends to notarised donations between parents and children, so the ISD cost is similar. The deciding factor is the donor's capital gains tax. A lifetime gift is a disposal for Spanish CGT; death is not. Heirs who inherit receive a stepped-up acquisition value equal to the valor de referencia at death, which reduces their future CGT if they later sell. For most families, inheritance beats gifting on tax; gifting wins when parents want certainty and the next generation needs the asset now.

**What paperwork do heirs need from day one?**
NIE numbers for every heir, the deceased's Spanish will (or a European Certificate of Succession if there is none), the certificado de últimas voluntades, the escritura of the property, a current nota simple, the last IBI receipt, the community of owners certificate, and bank statements for any Spanish accounts. A [power of attorney](/blog/power-of-attorney-spain-property-purchase-2026) issued in the heir's country, apostilled and translated, lets a Spanish lawyer handle the entire acceptance of inheritance without the family travelling.
