# Spain Notary Delay 2026: How Long the Wait Really Is

Fifteen working days is the realistic gap between requesting a notary slot on the Alicante coast in August 2026 and signing the escritura, and in the worst weeks it reaches twenty. If your contrato de arras fixes completion for a date the notaría cannot serve, one of the two parties is in breach, and it is usually the buyer who pays for that.

## How long a notary slot takes in 2026

In Spain the buyer picks the notary. Article 126 of the Reglamento Notarial gives that choice to whoever pays the notarial fees, and on the coast the contract almost always puts those on the buyer, so a full diary in Torrevieja is an inconvenience rather than a wall. Real Decreto 1426/1989 fixes those fees by tariff, so ringing three offices instead of one saves you time, not money. Offices in the same town also fill up together, because they absorb the same wave of transactions.

Those are our own booking times across 2026 completions rather than an official series, and they move week to week. Coastal towns with heavy second-home turnover queue longest, while inland offices barely queue at all. ## What is building the queue

Volume comes first. The [Consejo General del Notariado](https://www.notariado.org/) publishes monthly transaction statistics through its statistical information centre, and through the strongest months of 2026 national home sales have run in the region of 55,000 a month. Each of those sales occupies a slot in someone's diary.

August is the second driver. Notarías close for holidays, the regional colegio runs a rota to keep a share of offices open, and that share is small at exactly the point where coastal demand peaks. The ten days before Christmas do the same thing, when buyers push to close inside the tax year.

Third, non-resident files carry more checks. Ley 10/2010 on money laundering requires the notary to establish the source of funds, Ley 36/2006 requires the deed to record the means of payment, and the notary reports the file to the profession's centralised prevention body. Money arriving from a bank the notary has never dealt with, or from an account that is not in the buyer's name, generates questions that take days to answer rather than minutes. Fourth, a mortgage means two notary visits rather than one. Ley 5/2019 obliges the lender to deliver the FEIN and the standardised warning sheet at least ten calendar days before signing, and the borrower must attend the notary for the free transparency act no later than the day before the loan deed. That is two slots in the same diary, ten days apart, usually inside the same peak week. ## The arras date is a deadline, not an aspiration

Most Costa Blanca sales run on arras penitenciales under article 1454 of the Código Civil, with the buyer putting down 10%. On [WES-1410, a 1-bed 77 m2 apartment in Cala Finestrat at EUR 275,000](/property/wes-1410), that is EUR 27,500 sitting with the seller or the agency until completion. Walk away and you lose it; if the seller walks, they owe you double.

Arrive on day 61 of a 60-day contract because the notaría had nothing free, and the seller may treat you as the party in default. Most sellers grant an extension without argument. In a town where prices have moved since April, some of them will not, and a missed date becomes a cheap way out of a contract the seller regrets. The fix sits in the drafting. Name the notaría in the contract, and add an automatic extension of fifteen calendar days where the delay comes from notary availability or from mortgage formalities, triggered by written notice. Sellers rarely refuse that clause, because it protects them too. Beyond the wording, five habits keep the date safe.

**Book the slot the day the arras is signed.** Not when the mortgage is approved, not when the survey comes back. A provisional appointment can be moved; an empty diary cannot be filled at two days' notice.

**Ask for 60 days, not 30.** With a Spanish mortgage, ask for 75 to 90. The extra weeks cost nothing and cover the whole margin of error.

**Have the money in Spain three working days early.** Banks do not issue drafts on demand, and cash movements of EUR 100,000 or more inside Spain require a Modelo S1 declaration. Send the funds from an account in your own name.

**Send the file to the notaría a week ahead.** NIE, updated nota simple, community debt certificate, latest IBI receipt, energy certificate.
