# Spain Foreclosure 2026: How Long It Takes, How Often It Happens

> Roughly 25,000 foreclosure proceedings were initiated in Spain in 2025 according to INE, a fraction of the 2014 peak near 130,000. The procedure still runs 18 to 36 months on average. Here is what that means for buyers in 2026.

Roughly 25,000 ejecución hipotecaria proceedings were initiated across Spain in 2025 according to the INE's Estadística sobre Ejecuciones Hipotecarias, a fraction of the 2014 peak above 130,000. Primary residences account for a minority of filings. The procedure still takes 18 to 36 months to reach auction, and the queue has not shortened in 2026. Buyers hunting bank stock should price the delay in.

## How many foreclosures are actually happening in Spain in 2026?

Fewer than most foreign buyers assume. The post-crisis Spanish foreclosure rate collapsed between 2015 and 2022 as household balance sheets repaired, Euribor stayed negative, and banks sold distressed books in bulk to funds. The 2023 Euribor spike pushed the count up modestly, but the feared 2024 to 2026 wave never materialised at scale. The figures from the [INE foreclosure series](https://www.ine.es/dyngs/INEbase/en/operacion.htm?c=Estadistica_C&cid=1254736176993):

| Period | Proceedings initiated (all property) | On primary residences |
|---|---|---|
| 2014 (peak) | ~130,000 | ~70,000 |
| 2019 | ~45,000 | ~22,000 |
| 2022 | ~27,000 | ~13,000 |
| 2024 | ~26,000 | ~12,000 |
| 2025 (provisional) | ~25,000 | ~11,000 |

Figures rounded. The Banco de España's June housing report, summarised in our [Bank of Spain June 2026 note](/blog/bank-of-spain-housing-market-report-june-2026-2026-06-15), attributes the plateau to fixed-rate mortgage conversions during 2020 to 2022 and to resilient employment. Regional dispersion is wide: Andalucía, the Valencian Community and Catalonia continue to lead in absolute numbers, broken down in our [regional repossession overview](/blog/spain-bank-repossession-data-regional-2026).

## How long does an ejecución hipotecaria take?

From the first missed payment to the auction award, 24 months is a realistic average and 36 is not unusual. The simplified sequence:

1. Three unpaid monthly instalments trigger the bank's right to declare early maturity under Ley 5/2019.
2. The bank files the demanda ejecutiva at the Juzgado de Primera Instancia where the property sits.
3. The borrower receives the requerimiento de pago. They have ten business days to oppose or settle.
4. If no settlement, the court orders the subasta (public auction) via the Portal de Subastas of the BOE.
5. Award to the highest bidder or, if the auction fails, to the bank at 70 percent of the valuation for a primary residence or 50 percent otherwise.
6. Eviction (lanzamiento) is a separate hearing and often adds six to twelve months, especially where the occupant qualifies as vulnerable under the moratoria extended into 2028.

Court backlogs vary. Málaga and Alicante are among the slowest. Our note on [notary appointment waits](/blog/spain-notary-delay-2026-appointment-wait-times) covers related delays in the civil pipeline. The Euribor path matters too: a renewed rise would feed arrears a year later, which is why our [Euribor July 2026 update](/blog/euribor-july-2026-spanish-mortgage-impact) is worth watching.

## What should a buyer of foreclosed property do in 2026?

Three points for international buyers.

**Stock is thin and uneven.** Spanish banks (Santander, BBVA, Sabadell, CaixaBank) and their servicers (Haya, Anticipa, Solvia, Aliseda) still hold REO portfolios, but the pricing advantage versus the open market has narrowed to roughly 5 to 15 percent, not the 30 to 40 percent of 2016. Occupied units with vulnerable tenants cannot be delivered vacant for years. Read the file before you bid.

**Clean title is not automatic.** The adjudication deed clears the mortgage, but unpaid IBI, community fees and plusvalía municipal travel with the property. Always pull a [nota simple from the Land Registry](/blog/spain-land-registry-check-nota-simple-2026), cross-check against the [Catastro cadastral reference](/blog/cadastral-reference-spain-catastro-2026), and have a Spanish lawyer confirm the lien order. Our [lawyer fees guide](/blog/spanish-lawyer-fees-2026-property-purchase-cost) covers the typical cost.

**Financing a foreclosed purchase is harder, not easier.** Lenders are cautious on BOE auction purchases and on repossessed stock that has stood empty. If you need credit, read our [non-resident mortgage overview](/blog/mortgage-for-non-residents-spain) before you register for an auction. The deposit at the Portal de Subastas is 5 percent of the valuation and is forfeited if you cannot complete.

For owners currently in arrears, the Código de Buenas Prácticas (last broadened by Real Decreto-ley 19/2022 and extended) allows restructuring, reduced interest and in severe cases dación en pago. Engage the bank before the demanda is filed; options collapse once the court has the file.

### FAQ

**Can a foreign buyer bid at a Spanish auction?**
Yes. You need a NIE, a Spanish bank account funded for the 5 percent deposit, and electronic ID (certificado digital or Cl@ve) to register on the Portal de Subastas de la Agencia Estatal BOE. A power of attorney lets a Spanish lawyer bid on your behalf, covered in our [POA for property purchase guide](/blog/power-of-attorney-spain-property-purchase-2026).
